§ 1 Verwender

§ 2 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen gelten für alle Rechtsgeschäfte zwischen dem Shopbetreiber (Leon Koopmann) und einem Verbraucher (gem. § 13 BGB jede „natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können“).
§ 3 Vertragsschluss und Speicherung des Vertragstextes
Die Bestimmungen dieser AGB gelten für Bestellungen, welche der Verbraucher im Shop auf der Website soulsplitter.com abschließt. Der Vertrag kommt mit dem Shopbetreiber (siehe § 1) zustande. Die Vorstellung und Beschreibung der Waren auf der Internetseite des Modellshops soulsplitter.com/main stellt kein Vertragsangebot dar. Mit der Bestellung einer Ware durch einen Klick auf den Button „Buy Now“ am Ende des Bestellvorgangs gibt der Verbraucher ein verbindliches Angebot auf einen Kaufvertragsabschluss ab. Erst mit dem Versand einer Auftragsbestätigung per E-Mail durch den Shopbetreiber kommt der Vertragsschluss zustande. Der Vertragstext wird bei Bestellungen gespeichert. Nach Vertragsschluss sind die Bestelldaten nicht mehr online einsehbar. Verbraucher erhalten eine E-Mail mit den Bestelldaten und einem Verweis auf die geltenden AGB und Datenschutzbestimmungen.
§ 4 Zahlung
Die gesetzliche Umsatzsteuer (wird gem. 19 UStG nicht erhoben) sowie weitere Preisbestandteile sind in den angegebenen Preisen inbegriffen. Versandkosten sind nicht im angezeigten Preis enthalten, werden aber ggf. vor Vertragsschluss berechnet und angezeigt. § 5 Lieferung, Lieferungsbeschränkungen
Die Lieferung erfolgt – sofern die Beschreibung eines gewählten Produkts nicht explizit Abweichendes festlegt – innerhalb von 7 Werktagen per Deutsche Post oder DHL. Diese Frist beginnt mit Zahlungseingang. Bei Sendungen ins Ausland kann es zu längeren Lieferzeiten und zum Versand mit anderen Dienstleistern kommen. Die Versandkosten trägt in jedem Fall der Verbraucher.
§ 6 Gefahrenübergang
Das Risiko einer zufälligen Verschlechterung oder einem zufälligen Verlusts der Ware liegt bis zur Übergabe der Ware beim Shopbetreiber und geht mit der Übergabe auf den Verbraucher über.
§ 7 Eigentumsvorbehalt
Bis zum vollständigen Empfang des Kaufpreises (ggf. zzgl. Versandkosten) verbleibt die Ware im Eigentum des Shopbetreibers.
§ 8 Gewährleistung und Widerrufsrecht
Es gelten die gesetzlichen Gewährleistungsregelungen (u.a. § 365 BGB) und das gesetzliche Widerrufsrecht (zwei Wochen gem. § 312g, 355 BGB, kein Widerrufsrecht bei Tonträgern gem. § 312g Abs. 2 Ziff. 6 BGB). Im Falle eines Widerrufs trägt der Verbraucher die Kosten der Rücksendung, im Fall einer Sachmängelhaftung jedoch der Shopbetreiber.
§9 Streitbeilegung
Die EU-Kommission hat eine Internetplattform zur Online-Beilegung von Streitigkeiten geschaffen. Die Plattform dient als Anlaufstelle zur außergerichtlichen Beilegung von Streitigkeiten betreffend vertragliche Verpflichtungen, die aus Online-Kaufverträgen erwachsen. Wir sind zur Beilegung von Streitigkeiten mit Verbrauchern zur Teilnahme an einem Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle bereit.

§ 2 Scope of application
These general terms and conditions apply to all legal transactions between the store operator (Leon Koopmann) and a consumer (according to § 13 BGB any “natural person who enters into a legal transaction for purposes that can be attributed predominantly neither to his commercial nor his independent professional activity”).
§ 3 Conclusion of contract and storage of the contract text
The provisions of these GTC apply to orders which the consumer concludes in the store on the website soulsplitter.com. The contract is concluded with the store operator (see § 1). The presentation and description of the goods on the website of the model store soulsplitter.com/main does not constitute a contract offer. By ordering a product by clicking on the button “Buy Now” at the end of the ordering process, the consumer makes a binding offer to conclude a purchase contract. Only with the dispatch of an order confirmation by e-mail by the store operator, the contract is concluded. The text of the contract is stored for orders. After conclusion of the contract, the order data can no longer be viewed online. Consumers receive an e-mail with the order data and a reference to the applicable terms and conditions and privacy policy.
§ 4 Payment
The statutory sales tax (is not levied in accordance with 19 UStG) and other price components are included in the prices shown. Shipping costs are not included in the displayed price, but may be calculated and displayed before the conclusion of the contract. § 5 Delivery, delivery restrictions

§ 6 Transfer of risk

§ 8 Warranty and right of withdrawal
